Psycamore Offers Settlement to City of Ocean Springs

The attorneys for Psycamore Psychiatric Clinic are offering to drop their case and the remaining $400,000 the city owes. Rodger Applewhite and Psycamore sued the City of Ocean Springs for violations of the Americans with Disabilities Act.

The controversy started after a flyer was passed around the community where a Psycamore clinic was planned, depicting Jack Nicholson’s character from One Flew Over the Cuckoo’s Nest, asking for residents to convince city officials to stop the clinic from coming to the community. The new offer will drop the pending lawsuit if the city assigns Applewhite’s attorney to any claims against Mississippi Municipal Services, the city’s insurer, regarding their denial of the liability claim made in the Psycamore case.

Mayor Connie Moran responded by saying, in part: "Such action may involve a risk that the city’s premiums could substantially increase or we could possibly be dropped from the pool altogether. The board will continue to weigh options and assess the potential risks."

Ocean Springs was a founding member of the Mississippi Municipal Services company, which was founded in 1986 to pool insurance premiums for state municipalities.
