Suspect asks about the Death Penalty

The Biloxi man charged in the shooting death of a Waffle House server made his first court appearance and asked about the death penalty.
Today, 45-year-old Johnny Mount asked Judge Albert Fountain whether or not the death penalty would be involved in his case. Fountain explained that Mount faces only one count of first-degree murder and not a capital offense. The judge told Mount that he would be appointed a public defender.
Mount is charged in Friday’s shooting death of 52-year-old Julie Brightwell, a server at Waffle House who police say was trying to get Mount to stop smoking in the restaurant when he pulled out a handgun and shot her.
Mount is being held on a $2 million bond.
