Message therapist accused of filming female client set for retrial
A message therapist convicted in 2016 of secretly filming a female client while she changed is getting a new trial.
Edward Pierce, of Long Beach, was originally sentenced to five years in prison with three years suspended. The court says the judge wrongfully closed the courtroom during the 2016 testimony of the woman videotaped by Pierce. According to the law, only the review of the tape itself should have been closed to the public.
The court also says the judge wrongfully omitted jury instruction that Pierce should be found innocent if the jury deliberated that he had taped his client by mistake, which was Pierce’s defense.
