State Supreme Court clears the way for pier at Veterans Avenue

The Mississippi Supreme Court on Thursday said that RW Development can move ahead with the construction of a pier on the beach south of  Veterans Avenue.

The decision says that a Chancery Court judge sided with RW Development, Biloxi and Harrison County in leasing property to RW to develop and public/private pier seaward of Veterans Avenue.

The state immediately requested declaratory judgment stating that the state is the the sole and exclusive authority to lease tidelands.

The Harrison County Chancery Court denied the state’s request, saying the city and county had statutory authority to lease the property to RW for public use.

The supreme Court affirmed the lower court’s ruling.
