Inmate sues Harrison County, sheriff after alleged assault, rape at jail

A Harrison County inmate has sued Harrison County and Sheriff Troy Peterson and unnamed defendants, claiming he was assaulted and raped while in the county jail.

The inmate filed a federal lawsuit on December 2, asking for compensatory and punitive damages to be determined at trial. He says he was deprived of his civil rights, there was a conspiracy to interfere with those rights,  the county failed to stop the conspiracy and breach of duty.

The inmate claims that after his arrest on drug charges in July 2022, he was assigned to a cell with Andrew Malik Jones and another inmate. Jones was arrested on charges of assaulting, robbing and raping a woman at Premium Outlets.

After the third inmate was taken out of the cell, the defendant says Jones assaulted and raped him, then threatened further violence if he reported it.

When he did report it, the inmate said jailers questioned him in front of other inmates and corrections officers.

He also claims he was ridiculed by a deputy in front of hospital staff and others — and that the deputy took a photo on his phone of the inmate at the hospital.

The inmate said once back at the jail, follow-up treatment consisted of a counselor and another mental health professional questioning him about the incident in front of numerous other inmates and corrections officers.
