Capital murder suspect in court for preliminary hearing in toddler’s death

A Biloxi man accused of capital murder in the death of his two-year-old stepson was in court Wednesday for a preliminary hearing.

Our media partner the Sun Herald reports Biloxi Investigator Nick Sonnier said 21-year-old Hailey Lynn Heard told police her husband, 38-year-old James David Heard, held his son’s hands over his head while punching him in the stomach two days after Christmas last year.

She also told police she held her hand over the toddler’s mouth to get him to stop crying until she realized he was turning blue.

Hayden ‘Bam Bam’ died after being taken to the hospital.

Sonnier said police say bruising on the child and the parents offered conflicting stories about what happened to the boy.

The couple originally was charged with felony child abuse, but the charges were upgraded to capital murder after Hayden died.

Hailey Heard changed her story after being arrested in January.

Judge Gaston Hewes Jr. ordered the case to the grand jury. A trial has not been set and the couple remain jailed without bond.
