Mississippi Supreme Court reinstates lawsuit in child sexual assault case

The state Supreme Court announced a child sexual assault case dating back to 2014 has been sent back to Circuit Court.

The case, involving an eight-year-old student who was sexually assaulted by her bus driver, Sergio Sandoval, has been sent back to the Jackson County Circuit Court.

The victim’s family had filed a civil suit against the Ocean Springs School District, claiming it did not follow procedures and policies that could have prevented the sexual assault from happening.

The school since filed a motion to dismiss, claiming civil liability immunity which the circuit court agreed to. The victim’s family appealed that ruling to the state supreme court, who has now sent it back for further disposition.

Sandoval was convicted on criminal charges and is currently serving his jail sentence.
